Whereas, pursuant to subsection 332(1)referencehasof the Canadian Environmental Protection Act (1999)referenceb, the Minister of the Environment caused to be published in the Canada Gazette , Part I , on December 25, 2021, the proposed regulations entitled Prohibiting Single-Use Plastics Regulations , substantially as set out below, and that the interested parties thus had the opportunity to present their observations in this regard or a reasoned notice of opposition requesting the constitution of a board of review;

Whereas, pursuant to subsection 93(3) of that Act, the National Advisory Committee has been given the opportunity to formulate its advice under section 6 referencevsof it;

Whereas the Governor in Council is of the opinion that, under subsection 93(4) of that Act, the proposed Regulations do not affect a matter already regulated under another federal statute so as to provide protection sufficient for the environment and human health,

To these causes, on the recommendation of the Minister of the Environment and the Minister of Health and pursuant to subsection 93(1) of the Canadian Environmental Protection Act, 1999 referenceb, Her Excellency the Governor General in Council makes the following Prohibition of Single -Use Plastics Regulations .

disposable plastic rings for beverage packaging

Manufactured articles of plastic, made wholly or partly of plastic, in the form of a series of rings or deformable strips which are designed to surround beverage containers and enable them to be transported together. ( single-use plastic ring carrier )

disposable plastic stir stick

Manufactured plastic, made wholly or partly of plastic, which is designed to stir or mix drinks or to prevent the spillage of a drink from the lid of its container. ( single-use plastic stir stick )

disposable plastic straw

Manufactured article made of plastic, made entirely or partly of plastic, in the form of a straw that is used for drinking and that meets one or more of the following criteria:

(a) it contains polystyrene or polyethylene;

(b) its physical properties change after 100 washes in an electrically powered household dishwasher. ( single-use plastic straw )

disposable plastic flexible straw

Single-use plastic straw with a hinged segment that allows it to be bent and held in position at different angles. ( single-use plastic flexible straw )

single use plastic food container

Manufactured article made of plastic, composed entirely or partly of plastic, which at the same time:

(a) is in the shape of a clamshell container, lidded container, box, tumbler, plate or bowl;

(b) is designed to serve or transport ready-to-eat food or beverages;

  1. c) contains expanded polystyrene foam, extruded polystyrene foam, polyvinyl chloride, plastic containing a black pigment produced by the partial or incomplete combustion of hydrocarbons or oxodegradable plastic. ( single-use plastic foodservice ware )

single use plastic shopping bag

Plastic manufactured item, made wholly or partly of plastic, in the form of a bag that is designed to carry items purchased from a business and that meets either of the following criteria:

(a) the plastic is not a fabric within the meaning of Section 2 of the Textile Labeling Act ;

(b) the plastic is a fabric within the meaning of section 2 of the Textile Labeling Act , and it breaks or tears, as the case may be:
